Terms and Conditions

PLEASE READ THEM CAREFULLY

These Terms & Conditions govern the relationship between you (“Client”, “Traveler”, “Passenger”, “you”, or “your”) and Adler Adventure Travel Pvt. Ltd. (“Company”, “we”, “our”, or “us”), a travel and tour operator based in Nepal.

By booking any tour, trek, expedition, transportation, accommodation, or other travel service with Adler Adventure Travel Pvt. Ltd., you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

These Terms & Conditions apply to all bookings made directly with Adler Adventure Travel Pvt. Ltd. or through authorized agents or partners.

BOOKING & CONTRACT

A booking becomes confirmed only after:

  • The required advance payment has been received by Adler Adventure Travel Pvt. Ltd.
  • The Company has issued a written confirmation of the booking; and
  • The Client has provided all required information and documentation necessary for the trip.

The person making the booking confirms that they are authorized to accept these Terms & Conditions on behalf of all persons included in the booking.

Adler Adventure Travel Pvt. Ltd. reserves the right to refuse any booking at its sole discretion.

PRICING & QUOTATIONS

All quotations are subject to availability and may change without prior notice until the booking is confirmed.

Prices are generally based on current transportation costs, fuel prices, government taxes, exchange rates, permit fees, and supplier charges applicable at the time of quotation.

The Company reserves the right to revise prices before final confirmation due to:

  • Currency exchange fluctuations;
  • Government tax increases;
  • Permit fee revisions;
  • Fuel surcharges;
  • Supplier cost increases; or
  • Circumstances beyond our control.

Any such changes will be communicated to the Client before confirmation.

DEPOSIT & PAYMENT TERMS

To secure a booking, a non-refundable advance payment equal to 30% of the total trip cost is required.

Unless otherwise specified in writing, the remaining balance must be paid no later than 10 days before the trip start date.

For certain trips, expeditions, peak-season departures, flights, permits, or special arrangements, full payment or earlier balance payment may be required. In such cases, the applicable payment deadline will be communicated at the time of booking.

If the balance payment is not received by the due date, Adler Adventure Travel Pvt. Ltd. reserves the right to treat the booking as cancelled, and cancellation charges shall apply in accordance with these Terms & Conditions.

No Client shall be entitled to participate in any trip unless full payment has been received by the Company.

PAYMENT METHODS & BANK CHARGES

Payments may be made through:

  • International bank transfer;
  • Wise or similar international transfer platforms (subject to availability);
  • Credit/debit card facilities where available; or
  • Other payment methods approved by the Company.

The Client is solely responsible for all bank charges, intermediary bank fees, transaction charges, currency conversion fees, and payment processing costs associated with the transfer of funds.

Adler Adventure Travel Pvt. Ltd. shall receive the full invoiced amount net of all charges and deductions.

The Company does not accept responsibility for payment transfer fees and reserves the right to request additional payment where deductions occur.

Please note that PayPal services are currently not officially supported in Nepal, and therefore Adler Adventure Travel Pvt. Ltd. does not accept PayPal payments.

TRIP CHANGES & TRANSFERS

Subject to availability, Clients may transfer their booking to another departure date or another available trip free of charge up to 30 days prior to the original departure date. Requests made less than 30 days prior to departure shall be treated as cancellations and subject to the cancellation charges outlined below. Any price difference between the original booking and the amended trip shall be payable by the Client.Only one complimentary transfer/change is permitted per booking unless otherwise agreed in writing by the Company.

CANCELLATION BY CLIENT

All cancellation requests must be submitted in writing by email or other official written communication.

Cancellation charges shall apply as follows:

The cancellation charges above represent minimum charges. 

Certain services such as domestic or international flights, permits, peak-season accommodations, special transportation, third-party bookings, or customized arrangements may carry higher non-refundable charges imposed by suppliers.

Where applicable, such supplier charges shall be payable by the Client in addition to the cancellation charges stated above.

Refunds, where applicable, shall be processed within a reasonable period after deduction of applicable charges, taxes, bank fees, and supplier penalties.

Bank transfer and refund transaction fees shall be borne by the Client.

CANCELLATION OR CHANGES BY THE COMPANY

Adler Adventure Travel Pvt. Ltd. reserves the right to modify itineraries, accommodations, transportation, schedules, routes, guides, or other travel arrangements where reasonably necessary due to operational, weather-related, safety-related, governmental, or other circumstances beyond the Company’s control.If a significant change becomes necessary prior to departure, the Company shall make reasonable efforts to inform the Client as soon as practicable.

In the event the Company cancels a trip before departure for reasons other than the Client’s default, the Client shall be entitled to one of the following remedies:

  • Transfer to another available departure or tour;
  • Credit toward a future booking; or
  • Refund of recoverable payments received by the Company.

The Company shall not be liable for any indirect or consequential losses including, but not limited to:

  • International airfare;
  • Visa expenses;
  • Hotel reservations booked independently;
  • Travel insurance costs;
  • Loss of income;
  • Loss of enjoyment; or
  • Additional personal expenses.

FORCE MAJEURE

Adler Adventure Travel Pvt. Ltd. shall not be liable for failure to perform, delay, modification, interruption, or cancellation of any trip resulting from circumstances beyond its reasonable control (“Force Majeure”).

Force Majeure includes, but is not limited to:

  • Natural disasters;
  • Floods, earthquakes, landslides, avalanches, or severe weather;
  • Political instability or civil unrest;
  • Strikes or labor disputes;
  • Government restrictions or policy changes;
  • Border closures;
  • Epidemics or pandemics;
  • Transportation disruption;
  • Flight cancellations;
  • Permit restrictions;
  • Acts of terrorism; or
  • Any other unforeseeable event beyond the Company’s control.

In such circumstances, additional costs arising from delays, rerouting, evacuation, accommodation, transportation, or other services shall be the responsibility of the Client.

TRAVEL INSURANCE

Comprehensive travel insurance is strongly recommended and may be mandatory for certain trips, particularly trekking, mountaineering, expedition, or high-altitude programs. Clients are responsible for obtaining insurance covering, at minimum:

  • Medical expenses;
  • Emergency evacuation and helicopter rescue;
  • Trip cancellation or interruption;
  • Personal accident;
  • Loss or theft of baggage and valuables; and
  • Repatriation expenses.

The Company accepts no liability for losses or expenses incurred due to inadequate insurance coverage.

HEALTH, FITNESS & MEDICAL CONDITIONS

The Client is responsible for assessing their own suitability and fitness for the trip booked.

Clients must disclose any relevant medical condition, disability, allergy, dietary restriction, or physical limitation before booking.

The Company reserves the right to decline participation or remove a Client from a trip where their condition, behavior, or fitness may endanger themselves or others or negatively affect the trip.

No refund shall be provided in such circumstances.

PASSPORTS, VISAS & TRAVEL DOCUMENTS

Clients are solely responsible for obtaining and carrying all necessary:

  • Passports;
  • Visas;
  • Permits;
  • Vaccination certificates; and
  • Other travel documentation required for the journey.

The Company shall not be liable for any losses, delays, denied boarding, denied entry, or additional costs arising from incomplete or invalid documentation.

CLIENT CONDUCT & RESPONSIBILITY

Clients agree to comply with local laws, customs, regulations, and instructions provided by guides, tour leaders, drivers, and Company representatives.

The Company reserves the right to remove any Client from a trip without refund where their conduct is considered:

  • Dangerous;
  • Disruptive;
  • Abusive;
  • Illegal;
  • Offensive; or
  • Likely to negatively affect the safety, comfort, or enjoyment of others.

Clients shall be responsible for any damage or loss caused by their actions and shall indemnify the Company against any resulting claims or expenses.

TRANSPORTATION & DELAYS

Transportation schedules are subject to change without notice due to weather, operational, technical, or governmental reasons.

The Company shall not be liable for:

  • Flight delays or cancellations;
  • Missed connections;
  • Road closures;
  • Mechanical breakdowns;
  • Delayed baggage; or
  • Transportation disruption beyond its control.

Any additional accommodation, meals, transport, or related expenses arising from such events shall be borne by the Client unless otherwise covered by insurance.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Adler Adventure Travel Pvt. Ltd.’s liability for any claim arising out of or related to the trip shall be limited to the amount paid by the Client for the relevant services.

The Company shall not be liable for any indirect, incidental, special, or consequential damages including loss of profits, loss of enjoyment, emotional distress, or business interruption.

Adventure travel, trekking, mountaineering, and travel in remote regions involve inherent risks. By participating, the Client acknowledges and voluntarily accepts such risks.

COMPLAINTS

Any complaint arising during the trip must be communicated immediately to the guide, tour leader, or Company representative in order to provide an opportunity to resolve the matter promptly.

Failure to notify the Company during the trip may affect the Company’s ability to investigate and address the complaint.

PRIVACY & DATA PROTECTION

The Company collects and processes personal information solely for purposes related to:

  • Booking administration;
  • Permit processing;
  • Travel operations;
  • Supplier coordination; and
  • Customer communication.

Personal information may be shared with relevant suppliers, government authorities, or service providers where necessary for trip operations.

The Company will take reasonable measures to protect personal data but cannot guarantee absolute security of electronic communications.

Unless otherwise requested in writing, photographs or videos taken during trips may be used for promotional and marketing purposes.

GOVERNING LAW & JURISDICTION

These Terms & Conditions shall be governed by and construed in accordance with the laws of Nepal.

Any dispute arising in connection with these Terms & Conditions or any services provided by Adler Adventure Travel Pvt. Ltd. shall be subject to the exclusive jurisdiction of the competent courts of Nepal.

ACCEPTANCE OF TERMS

By confirming a booking with Adler Adventure Travel Pvt. Ltd., the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions in full.
